Here's what to do after an accident to protect your wellbeing and legal rights:
- Seek medical attention or render assistance.
- Call the police if there are injuries or vehicle damage in excess of $500.
- Cooperate with all law enforcement and emergency personnel.
- Get the license plate numbers of all the vehicles involved and the drivers' names, addresses, telephone numbers and insurance information.
- Write down the names, addresses and phone numbers of all potential witnesses.
- Take photographs of the accident scene, personal injuries and property damage.
- Get examined at a hospital ER or see your primary care provider without delay.
- Call an experienced motor vehicle accident attorney to discuss your case.
- Notify your health and/or automobile insurance companies to preserve your right to later make claims.
- Use caution in discussing the accident, especially with an insurance company. Don't admit fault or apologize.
- Be wary of signing any document without consulting your attorney or doctor. Do not sign insurance release or settlement papers no matter what your condition without expert legal counsel.
- Keep a record of all expenses, including mileage to and from your health care provider's office and all time missed from work.
- Keep a diary of all changes in your life as a result of your injuries, including activities missed, pain/discomfort levels, work-related or family-related problems or lost opportunities.
- Notify your attorney and doctor of any change of address, phone number, employer or marital status.
- Promptly submit claims
to your own Personal Injury Protection (PIP) carrier for payment of health
care expenses or wage loss.
